IRS Extends Furnishing Deadline for 2020 Forms 1095-B and 1095-C to March 2, 2021
On Oct. 2, 2020, the IRS announced it will again extend the Jan. 31 deadline for furnishing Forms 1095-B, Health Coverage, and 1095-C, Employer-Provided Health Insurance Offer and Coverage, as it has done for the past four years. The notice also provides that the IRS will not impose a penalty under section 6722 for failures to furnish a Form 1095-B to recipients if certain requirements are met. Please see Notice 2020-76 for further reference. This is an automatic extension.
Report the information required under sections 6055 and 6056 about offers of health coverage and enrollment in health coverage for their employees.
Copies must be furnished to recipients by March 2, 2021
They must be filed with the IRS by:
- February 28, 2021, if filing by paper
- March 31, 2021, if electronically filing

The Affordable Care Act (ACA) Employer Shared Responsibility Rule requires employers to file annual information returns 1095-B and/or 1095-C with the IRS and deliver employee copies with health plan coverage information. Transmittal forms 1094-B and/or 1094-C also need to be filed with the IRS.
Forms 1095-B and 1095-C are used to report to the IRS, enrolled employees and former employees, details of employees’ health insurance coverage, including verification that the minimum essential coverage (MEC) requirement has been met. Employees and their dependents will use this information to complete their personal tax returns – and those who do not have minimum essential coverage may receive a penalty on their tax returns.
Who must report and send copies to employees?

■ Applicable large employers (ALEs) with 50 or more employees
■ Self-insured employers
